2. Users

The access and/or use of this TC portal attributes the condition of USER, who accepts, from said access and/or use, the General Terms and Conditions of Use reflected herein. The aforementioned Terms and Conditions shall apply regardless of the General Contract Terms and Conditions which herein are of mandatory compliance.


3. Portal use provides access to a multitude of information, services, programmes or data (hereinafter shall be referred to as "the contents") on the Internet belonging to TC or its licensors to which the USER may have access. The USER assumes responsibility for using the portal. Said responsibility extends to the register that is necessary to access certain services or contents.

In said record, the USER shall be responsible for furnishing accurate and lawful information. As a consequence of this registration, the USER may be provided a password for which he/she shall be responsible, undertaking to make a diligent and confidential use thereof. The USER hereby undertakes to make a proper use of the content and services (such as for example, chat services, discussion forums or newsgroups) that corporate name of the creator of the website offers through its portal and including but limited to, refraining from using same (i) to engage in illegal, unlawful activities, or those that are contrary to good faith and public order; (ii) to disseminate content or propaganda of a racist, xenophobic, pornographic-illegal character, justifying terrorism or which constitutes an attack against human rights; (iii) to cause damage to the hardware and software systems of corporate name of the creator of the website, its suppliers or third parties, to introduce or disseminate on the network computer viruses or any other hardware or software susceptible of causing the aforementioned damaged above; (iv) to attempt to gain access and, where appropriate, to use the email accounts of other users and to modify or manipulate their messages. Corporate name of the creator of the website reserves the right to withdraw all comments and contributions which infringe a person's dignity, that are discriminatory, xenophobic, racist, pornographic, which may be harmful to children or youth, jeopardise public order or public safety or which, in its opinion, are not suitable for publication. In either event, TC shall not be held responsible for the opinions voiced by users through forums, chats, or other participation tools.


4. Protection of data

TC complies with the guidelines of Organic Law 1720/2007 of 21 December, on Protection of Personal Data, Royal Decree 1720/2007 of 21 December, wherein the implementing regulations of Organic Law and other applicable legislation in force at all times were approved, and ensures a proper use and treatment of the user's personal data. To that end, together with each form for compiling personal data, in the services that the user may request from, shall inform the user of the existence and acceptance of the particular conditions of the treatment of his data in each case, informing the user of the responsibility of the file created, the address of the person responsible, the possibility of exercising their rights of access, rectification, cancellation or opposition, the purpose of the processing and the communication of data to third parties, where applicable.

Likewise, TC making known herein that it complies with Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce and shall request their consent for the processing of their electronic address for commercial purposes at any given moment.


5. Intellectual and industrial property

TC per se or as a transferee, is the owner of all intellectual and industrial property rights corresponding to its website, as well as the elements contained therein (including but not limited to, by way of example, images, sound, audio, video, software or texts; trademarks or logos, colour combinations, structure and design, selection of materials used, computer programmes necessary for operation, access and use thereof etc.), owned by TC or its licensors.

Pursuant to that set forth in Articles 8 and 32.1, paragraph two, of the Law on Intellectual Property the reproduction, distribution and public dissemination, including any means of making available, of all or part of the contents of this website, for commercial purposes, in any medium and by any technical means, without the authorisation of TC is strictly prohibited. The USER hereby undertakes to respect the rights of Intellectual Property and Industrial pertaining to TC. The USER may view the elements of the portal and even print, copy and store same on the hard drive of his computer, or any other hardware provided is solely and exclusively, for his personal and private use. The USER shall refrain from deleting, altering, evading or manipulating any protection device or security system that is installed on the TC web pages.


6. Disclaimer of liability and warranties

TC shall not be held liable, under any circumstances, for losses and damages of any kind, which may be caused by, including but not limited to, by way of example: errors or omissions in the contents, lack of availability of the portal or the transmission of viruses or programmes which are malicious or harmful in their content, in spite of having adopted all the necessary technological measures to avoid such occurrences.


7. Modifications

TC reserves the right, without prior notice, to make any modifications that it deems appropriate in its portal, being able to change, delete or add both the contents and services provided through the website and the manner in which they are presented or located in its portal.


8. Links

In the event that having links or hyperlinks to other Internet sites, TC shall not exercise any type of control over said sites and contents. Under no circumstances shall TC assume any responsibility for the contents of any link belonging to a third party website, nor shall guarantee the technical availability, quality, reliability, accuracy, scope, veracity, validity and constitutionality of any material or information contained in any of said hyperlinks or other Internet sites.

Likewise, the inclusion of these external connections shall not imply any type of association, merger or participation in related organisations.


9. Rights of exclusion

TC reserves the right to deny or withdraw access to the portal and/or services offered without prior notice, at its own initiative or at request of a third party, to those users who fail to comply with these General Terms and Conditions of Use.


10. General comments

TC shall pursue the breach of the present terms and conditions as well as any improper use of its portal by exercising all civil and criminal actions that may be applicable under the law.


11. Modifications of the present terms and conditions and duration

TC may at any given moment amend the terms and conditions stipulated herein, duly published as they appear herein.

The aforementioned terms and conditions shall be in effect during the time they are display and shall be valid until they are modified by other duly published terms and conditions.


12. Applicable law and jurisdiction

The relationship between TC and the USER shall be governed by prevailing Spanish regulations and any controversy shall be submitted to the Courts and Tribunals of the city of Bilbao, Spain.
